Lease Enforcement

The Higgs Law Firm is a Virginia law firm assisting clients in enforcing lease obligations and in lease asset recovery.  The enforcement of lease obligations and lease asset recovery are a specialized and complex area of the law.  Leases may be enforced in either state or federal court, and lease enforcement often involves the prosecution or defense of actions in bankruptcy court.

We have extensive experience in enforcing and defending the rights of lessors both in and out of court, including prosecuting and defending adversary proceedings in Bankruptcy Court, detinue actions [called "replevin" in some other states] for recovering leased property, UCC-compliant asset liquidation sales, and the collection of deficiencies.  We have successfully obtained what in Virginia is the seldom-granted extraordinary remedy of pre-judgment attachments and seizures of property.

The Higgs Law Firm was a founding member of the National Equipment Finance Association (NEFA).  NEFA is a national association serving independent equipment finance companies, lessors and brokers, and was formed through the merger of the United Association of Equipment Leasing (UAEL) and the Eastern Association of Equipment Lessors (EAEL).
